End User License Agreement

Welcome to CurrentSituation (“we,” “us,” or “the Service”). By creating an account, accessing, or using our platform, you agree to be bound by this End User License Agreement (“Agreement”). If you do not agree, you must not use the Service.
1. Description of Service
CurrentSituation is a live camera streaming platform that enables venue owners and operators (“Clients”) to deploy internet-connected cameras at their locations and broadcast real-time video streams to the public or authorized viewers. The Service includes:
- Live video streaming from venue-installed cameras
- Camera management and configuration tools
- Venue profile pages with location information and photos
- Viewer access to public live streams
- Administrative tools for account and subscription management
2. Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, complete, and current registration information
- Maintain the security of your password and account credentials
- Promptly notify us of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
3. Acceptable Use
You agree to use the Service only for lawful purposes. You shall not:
- Stream content that is illegal, obscene, defamatory, or infringes on the rights of others
- Use the Service to monitor individuals without their knowledge or consent where required by law
- Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems
- Interfere with or disrupt the integrity or performance of the Service
- Use automated tools to scrape, download, or redistribute stream content without authorization
- Misrepresent your identity or affiliation with any person or organization
4. Camera Placement and Privacy
If you are a Client deploying cameras through the Service, you are solely responsible for:
- Ensuring camera placement complies with all applicable local, state, and federal laws regarding surveillance and recording
- Providing appropriate notice to individuals who may be captured on camera (e.g., signage at venues)
- Obtaining any required consents for audio recording where applicable
- Not placing cameras in areas where individuals have a reasonable expectation of privacy (restrooms, changing rooms, private offices, etc.)
5. Content and Intellectual Property
You retain ownership of content you upload to the Service, including photos, venue descriptions, and camera configurations. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of operating and promoting the Service.
You are responsible for ensuring that any content you upload does not infringe on the intellectual property rights of others.
6. Subscriptions and Payment
Certain features of the Service require a paid subscription. By subscribing, you agree to:
- Pay all fees associated with your selected subscription plan
- Provide valid payment information and keep it current
- Accept that subscription fees are billed in advance on a recurring basis
- Understand that failure to pay may result in suspension or termination of your account
7. Service Availability
We strive to maintain reliable streaming service, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. We collect and process personal data as described therein, including:
- Account information (name, email, contact details)
- Usage data and analytics
- IP addresses and device information for security and compliance
- Camera stream metadata and configuration data
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURRENTSITUATION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless CurrentSituation and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of this Agreement, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:
- Your right to use the Service ceases immediately
- We may delete your account data after a reasonable retention period
- Provisions that by their nature should survive termination will remain in effect
12. Modifications to This Agreement
We reserve the right to modify this Agreement at any time. When we make material changes, we will notify you and require acceptance of the updated terms before continued use of the Service. Your continued use of the Service after accepting updated terms constitutes agreement to the modified terms.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which CurrentSituation operates, without regard to conflict of law principles.
